Return Policy

1. Introduction and scope

This Return Policy explains your right to withdraw from a purchase (right of withdrawal) and how to return products and request a refund when you buy VitaHerbion or other products from us via the website marketwarranted.ddd. This policy applies to consumers (natural persons acting for purposes outside their trade, business, craft, or profession) in the European Union and the Netherlands. It complements our Terms of Service and Privacy Policy.

2. Your right of withdrawal (14 days)

Under the European Consumer Rights Directive (2011/83/EU) and Dutch implementation (Burgerlijk Wetboek Book 7), you have the right to withdraw from a distance or off-premises contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party you nominate) take physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. by email or post) using the contact details above. You may use the model withdrawal form provided by the European Commission if you wish, but it is not mandatory. We will send you an acknowledgment of receipt of your withdrawal without delay.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the 14-day period has expired. If you withdraw, we will refund all payments received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery we offer). We will make the refund using the same means of payment you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund. We may withhold the refund until we have received the goods back or until you have supplied evidence of having sent them back, whichever is the earliest.

3. Returning the goods

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period of 14 days has expired. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. We recommend that you return the product in its original packaging where possible, and that you use a traceable delivery method so you can prove that you sent it back. Unless we have offered to collect the goods, you bear the direct cost of returning them. We will inform you of the return address (which may be our business address above or a returns centre we designate) when you notify us of your withdrawal.

4. Exceptions to the right of withdrawal

Under EU and Dutch law, the right of withdrawal does not apply to:

• Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery (e.g. unsealed capsules or opened bottles that cannot be resold for hygiene reasons). If the product is sealed and unopened, you may still withdraw and return it in its sealed state.
• Contracts for the supply of goods made to the consumer’s specifications or clearly personalised.
• Contracts for the supply of perishable goods.

If your order falls under one of these exceptions, we will inform you before or at the time of order. For sealed, unopened VitaHerbion products returned within the 14-day period, we will process the withdrawal and refund in accordance with this policy. For products that have been unsealed or used, we may still accept returns at our discretion (e.g. for faulty products) but the statutory right of withdrawal may not apply once the seal is broken, in line with the above exception.

5. Refund timing and method

We will process your refund without undue delay and in any event within 14 days from the day we receive the returned goods or from the day you provide evidence that you have sent them back. We will use the same payment method you used for the original transaction, unless you have expressly agreed otherwise. You will not be charged any fee for the refund. If we are unable to reimburse you via the original payment method (e.g. because the account is closed), we will contact you to arrange an alternative method. If you have received goods in the order, we may withhold the refund until we have received the goods back or evidence of their return.

6. Defective or non-conforming goods

If the product you received is defective, damaged, or does not conform to what was agreed (e.g. wrong product or quantity), you have statutory rights under Dutch and EU consumer law. You may be entitled to repair, replacement, a price reduction, or to rescind the contract and get a refund, depending on the circumstances. Please contact us as soon as possible with your order details and a description (and if possible photos) of the defect or non-conformity. We will respond and, where applicable, arrange return and refund or replacement in line with the law. Return shipping costs for defective or non-conforming goods may be borne by us; we will inform you when you report the issue.

7. Cancellation before dispatch

If you wish to cancel your order before it has been dispatched, please contact us as soon as possible. If we have not yet dispatched the product, we will cancel the order and refund any payment already made, without undue delay.

For any return, withdrawal, or refund request, please contact us with your name, order reference or date of order, and the reason for the return. We will guide you through the process and provide the return address and any further instructions.

9. Changes to this Return Policy

We may update this Return Policy from time to time to reflect changes in our practices or in the law. The “Last updated” date at the top will be revised accordingly. Changes will not affect your right of withdrawal for orders placed before the change, where the 14-day period is still running. We encourage you to review this page when you consider making a return.
